Terms of Use
Current terms for using this site and its services.
Last updated: 19 September 2026
1. Who these terms are with
These terms apply to higherstate.app and to the Higher State OS programs, assessments, and content offered through it. In these terms, "we" and "us" mean Adrian Provost, operating from 191 Peachtree Street NE, Suite 1400, Atlanta, Georgia 30303, United States. Questions about these terms may be sent to bookings@adrianprovost.com. "You" means the person using the site or the organization you are authorized to bind. Use the contact form to reach us about anything on this page.
2. Acceptance
By using the site, creating an account, purchasing an offer, or submitting a form, you agree to the terms presented for that activity. If you do not agree, do not use that activity. A signed order form, enrollment agreement, MSA, SOW, or DPA controls where it conflicts with general site terms.
3. Educational scope
Content and programs provide education and performance-development tools. They are not medical, psychological, clinical, crisis, legal, financial, investment, HR, security, or regulated professional advice. The Higher State Index is a self-reported performance reflection, not a diagnosis, employment test, or prediction.
4. No guaranteed outcome
Site use, speaking, programs, and the Index do not guarantee revenue, conversion, promotion, negotiation, health, career, AI-safety, compliance, or another outcome.
5. Accounts and eligibility
Use accurate information; protect access links; use only named seats; do not share credentials.
6. Purchases and subscriptions
Access, renewal, cancellation, transfer, and refund terms appear before purchase. Program-specific terms must match checkout. Checkout is not currently open. Program pages accept expressions of interest only, and no payment is taken until enrollment opens and the terms for that offer are presented to you.
7. Acceptable use
Do not disrupt the service; attempt unauthorized access; harass others; submit unlawful or confidential data without authority; copy protected content at scale; train a model on protected content; impersonate another person; or use materials to deceive, discriminate, or manipulate.
8. Intellectual property
Adrian Provost names, Higher State OS materials, curricula, worksheets, diagrams, recordings, copy, and software remain owned by the verified rights holder or licensors. Access grants only the limited personal/internal-use license stated with the offer. No resale, facilitation, certification, sublicensing, public posting, derivative course, voice clone, likeness model, or AI training right is granted.
9. Your material
You retain rights in original information you submit and grant only the rights reasonably needed to deliver the selected service. You represent that you have authority to submit it. Do not submit customer, employee, health, financial, or other sensitive information unless the specific secure process permits it.
10. Community and recordings
Lab/cohort/event conduct, confidentiality, and recording rules apply. Teaching may be recorded only with notice and rights. Peer practice and private material are not recorded by default.
11. Third parties
Third-party tools and links have their own terms and privacy practices. Commercial relationships are disclosed near recommendations.
12. Disclaimers and limits
The site and its content are provided as they are. We do not warrant that the site will be uninterrupted, error free, or secure, and we do not warrant that any program, protocol, or assessment will produce a particular result for you. Nothing here excludes a liability that cannot be excluded under applicable law, including for fraud or for death or personal injury caused by negligence. Subject to that, we are not liable for indirect, incidental, special, consequential, or punitive loss, or for lost profit, lost revenue, lost data, or lost opportunity. Where liability cannot be excluded, the applicable offer terms state the total liability limit. A signed order form, enrollment agreement, MSA, or SOW may set different limits and controls where it does.
13. Suspension and termination
Access may be paused or ended for nonpayment, unlawful use, material confidentiality/IP violations, harassment, or security risk, subject to applicable terms and law.
14. Governing law and disputes
These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Fulton County, Georgia have exclusive jurisdiction over any dispute, and both parties consent to that venue. Before filing, please raise the issue through the contact form so we can try to resolve it directly. Nothing in this section removes a right you have to bring a claim in your local courts, or to use a consumer dispute process, where the law of your country of residence gives you that right regardless of this agreement.
15. Changes and contact
Material changes receive an updated date and any legally required notice. Use the contact form for legal questions.
